Terms of Use (Beta)

1. Provider and scope
consentdone is operated by Meikel Korfmacher, Fährstraße 179, 40221 Düsseldorf, Germany (see Imprint). These terms govern the use of the consentdone platform (admin portal, banner delivery, consent records) during the free beta phase. By registering an account you accept these terms.
2. Free beta — no guaranteed availability
consentdone is in a free beta phase. Use is free of charge. There is no entitlement to availability, freedom from defects, support, specific features, or permanent retention of stored data. Features may change at any time; the beta may be limited or discontinued with reasonable notice. Please back up important data (in particular consent records) regularly via the export function.
3. No legal advice — website operator remains responsible
consentdone is a technical tool for obtaining and documenting consent. It is not legal advice. Whether and how a website must obtain consent, which categories, services, cookies and texts must be declared, and whether a specific configuration meets legal requirements (in particular the GDPR) is the sole responsibility of the respective website operator. Templates, catalogues, automatic detections and defaults provided by consentdone are non-binding aids without any warranty of accuracy or completeness.
4. Data processing on your behalf (consent records)
Where consentdone stores records of your website visitors' consent decisions for you, you are the controller under the GDPR and we act as your processor (Art. 28 GDPR). We process this data solely to provide the service and according to your instructions (your configuration in the portal); the data comprises consent ID, categories, banner revision, timestamp, device type, browser family, country and a SHA-256 hash of IP and user agent (the IP address itself is not stored). Data is encrypted in transit and at rest; access is restricted to your account. Sub-processor: Cloudflare (hosting/database; EU-US Data Privacy Framework, standard contractual clauses). Export and deletion are available at any time via the account functions; deleting your account deletes the records. A separate data processing agreement is available on request during the beta phase.
5. User obligations
You agree to provide accurate registration details, keep your credentials confidential, and not misuse the service — in particular not to deliver unlawful content through configurable texts, not to register third-party domains without authorisation, and not to impair the technical infrastructure. Accounts violating these rules may be suspended or deleted.
6. Liability
As use during the beta phase is free of charge, we are liable — irrespective of the legal basis — only for intent and gross negligence. This limitation does not apply to damages arising from injury to life, body or health, to claims under the German Product Liability Act, or in cases of fraudulently concealed defects. No liability is assumed for the legal validity of consents obtained via consentdone or for the legal compliance of the configuration chosen by the user (see section 3).
7. Term and termination
You may terminate your account at any time without notice and request deletion of your data. We may terminate the beta as a whole or individual accounts with reasonable notice; in cases of misuse also without notice. We will give timely notice before any transition to a paid production service — no payment obligation arises automatically.
8. Changes to these terms
We may amend these terms with effect for the future, in particular upon transition from beta to regular operation or upon transfer of the service to a company yet to be incorporated. We will inform you about material changes by email to the address stored in your account.
9. Final provisions
German law applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. Information on the processing of personal data can be found in the privacy policy.
